Thesamefiery-tonguedeloquenceandfull-breastedchivalrywhichhadinturnsthrilledandoverawedfreemenatthepollswerenolessfervidandembattledbeforeajury。YettheColonelwascounselfortwoorthreepastoralDitchcompaniesandcertainbucoliccorporations,andalthoughhemanagedtoimportintothesimplestquestionofcontractmoreorlessabuseofopposingcounsel,andoccasionallymingledprecedentsoflawwithantecedentsofhisadversary,hislegalvictorieswereseldomcomplicatedbybloodshed。Hewasonlyonceshotatbyafree-handedjudge,andtwiceassaultedbyanover-sensitivelitigant。Nevertheless,itwasthoughtmerelyprudent,whilepreparingthepapersinthewellknowncaseof\"TheArcadianShepherds’AssociationofTuolumneversustheKedronVineandFigTreeGrowersofCalaveras,\"thattheColonelshouldseekwithashotguntheseclusionofhispartner’slawofficeinthesylvanoutskirtsofRoughandReadyforthatcompleterestandseriouspreoccupationwhichMarysvillecouldnotafford。

Seatedinawoodenarmchairbeforeatablecoveredwithbooksandpapers,yetwiththatapparentlyhaughtyattitudetowardsitaffectedbygentlemenofabdominalfullness,ColonelStarbottlesupportedhimselfwithonehandgraspingthearmofhischairandtheothervigorouslyplyingahugepalm-leaffan。Hewasperspiringfreely。Hehadtakenoffhischaracteristicbluefrock-coat,waistcoat,cravat,andcollar,and,strippedonlytohisruffledshirtandwhitedrilltrousers,presentedtheappearancefromtheoppositesideofthetableofhavinghastilyrisentoworkinhisnightgown。Aglasswithathinsedimentofsugarandlemon-peelremaininginitstoodnearhiselbow。Suddenlyablackshadowfellonthestaring,uncarpetedhall。Itwasthatofastrangerwhohadjustenteredfromthenoiselessdustofthedesertedroad。TheColonelcastarapidglanceathissword-cane,whichlayonthetable。

Heretheflutedwoodencolumnsoftheporticoandcolonnadeseemedtohavetakenuponthemselvesasoddenandunwholesomeageunknowntostoneandmortar。Mossandcreeperclungtopaintthattimehadneitherdriednormellowed,butleftstillglairyinitswhiteconsistency。Therewererustyredblotchesaroundinflamednail-
